1. Acceptance of Terms

By accessing or using the Imosto platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. Imosto SRL, a company registered in Romania ("Imosto", "we", "us"), operates the Service.

2. Description of Service

Imosto is a real estate platform that enables agents, agencies, and property owners to manage, list, and promote real estate properties. The Service includes listing management, team collaboration tools, document management, and related features.

3. Account Registration

To use the Service you must create an account. You agree to:

• Provide accurate and complete information during registration.
• Keep your credentials confidential and not share them with third parties.
• Notify us immediately of any unauthorised use of your account.
• Be at least 18 years old or have reached the age of legal majority in your jurisdiction.

You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

• Post false, misleading, or fraudulent property listings.
• Violate any applicable laws or regulations, including consumer protection and real estate laws.
• Infringe the intellectual property rights of others.
• Transmit malware, spam, or any harmful content.
• Scrape, crawl, or otherwise extract data from the platform without our written consent.
• Impersonate any person or entity.

5. Listings and Content

You retain ownership of content you submit to the Service (photos, descriptions, documents). By submitting content, you grant Imosto a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content solely for the purpose of operating and improving the Service.

You are solely responsible for the accuracy and legality of your listings. Imosto reserves the right to remove any listing that violates these Terms or applicable law.

6. Subscription and Payments

Certain features of the Service require a paid subscription. Fees are described on our pricing page and are subject to change with 30 days notice. All fees are exclusive of VAT, which will be added where applicable under Romanian and EU law.

Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled in accordance with Romanian consumer protection legislation (O.G. 34/2014 and Directive 2011/83/EU).

7. Intellectual Property

The Imosto name, logo, platform design, and all underlying software are the exclusive property of Imosto SRL and are protected by Romanian and EU intellectual property law. Nothing in these Terms grants you any rights in our intellectual property.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, Imosto disclaims all implied warranties.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Imosto shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. Upon termination, your right to access the Service ceases immediately. We may retain your data for up to 90 days before permanent deletion, in accordance with our Privacy Policy.

11. Governing Law and Disputes

These Terms are governed by Romanian law. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the courts of Bucharest, Romania, unless mandatory consumer protection law in your country of residence provides otherwise.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or a prominent notice in the Service at least 14 days before the changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
